What are we going to use your data for?
In general, your data will be used to be able to interact with you and to provide you with our services. Likewise, they can also be used for other activities, such as sending you advertising or promoting our activities.
Commercial communications and newsletter
We will send you information about our products, offers and news by email. The legal basis depends on your relationship with us: if you subscribed to the newsletter, your consent (Art. 6(1)(a) GDPR and Art. 21.1 of the Spanish LSSI); if you are a customer, our legitimate interest in informing you about products and services similar to those you have already purchased from us (Art. 6(1)(f) GDPR and Art. 21.2 LSSI); if you are a contact person at a customer company, our legitimate interest in maintaining the business relationship with that company (Art. 19 of the Spanish LOPDGDD). If you are a contact person at a customer company, your professional data (name, position, work email and phone) were provided to us by that company or by you when handling orders, quotes or incidents, and we do not process any others. Providing your email address for the newsletter is voluntary; without it we will not be able to send it to you. To decide which campaigns we send you we only use your price list or customer type and your country or province; the content of each offer is defined by catalogue (brand, product type, category and availability), not by your purchase history. We do not make automated decisions that produce legal effects concerning you. Emails are sent through email and hosting providers acting as processors in the European Union (currently Microsoft Ireland Operations Ltd., Azure Communication Services). If a provider accesses the data from outside the European Economic Area, it does so under an adequacy decision (Article 45 GDPR) or the safeguards of Article 46 (standard contractual clauses). We do not disclose your email address to third parties for commercial purposes; the disclosures to manufacturers described under “Who will know the information we ask you for?” do not include your email address or telephone number. We will keep your address until you unsubscribe or object; afterwards we will keep it blocked solely so that we do not write to you again. You can unsubscribe at any time and free of charge from the link included in every email, from your customer area or by writing to admin@muchocartucho.es. Unsubscribing does not affect the lawfulness of previous emails or your business relationship with us.
Why do we need to use your data?
Your data is necessary to be able to interact with you and to be able to provide you with our services. In this sense, we will put at your disposal a series of boxes that will allow you to decide clearly and simply about the use of your personal information.
Who is going to know the information we ask for?
In general, only the personnel of our entity that is duly authorized may know of the information that we request. Similarly, those entities that need to have access to it so that we can provide our services may know of your personal information. For example, our bank will know your data if the payment for our services is made by card or bank transfer. Likewise, those public or private entities to which we are obliged to provide your data due to compliance with any law will know your information. To give you an example, the Tax Law obliges you to provide the Tax Agency with some information on economic operations that exceed a certain amount. We also disclose certain data about your purchases to the manufacturers of the products you buy (currently HP, Epson and Brother) and, where applicable, to the providers that receive that information on their behalf. The manufacturers are independent controllers and use them to manage their distribution channel (for example, sales verification and reseller programmes). The legal basis is our legitimate interest in maintaining the business relationship with those manufacturers (Art. 6(1)(f) GDPR and, for companies and professionals, Art. 19 of the Spanish LOPDGDD). Our shop is aimed exclusively at companies and professionals. Therefore, the data the manufacturers may receive are the identification and tax details under which you invoice your activity (business name, tax ID and tax address), together with the transaction data (date, product, quantity, amount and invoice number); these disclosures do not include your email address or telephone number. If you are a sole trader or professional, we process these data only in that capacity (Art. 19 of the Spanish LOPDGDD). The manufacturers are established in the European Union or in countries with an adequacy decision; any access from outside the European Economic Area relies on Articles 45 or 46 GDPR. You may object to this disclosure at any time by writing to admin@muchocartucho.es. Outside the cases above, we do not disclose your information to other entities without first asking for your permission.
How are we going to protect your data?
We will protect your data with effective security measures based on the risks involved in the use of your information. For that, our entity has approved a Data Protection Policy, and annual controls and audits are carried out to verify that your data is safe at all times.
Will we send your data to other countries?
In the world, some countries are safe for your data, and others that are not so. For example, the European Union is a safe environment for your data. Our policy is not to send your personal information to any country that is not secure from a data protection point of view. If, in order to provide the service, a provider had to access your data from a country outside the European Economic Area it would do so only under an adequacy decision of the European Commission (Article 45 GDPR) or the safeguards required by Article 46 (standard contractual clauses or an equivalent instrument), and with additional security measures.
How long are we going to keep your data?
We will keep your data during our relationship and as long as the law requires us. Once the applicable legal deadlines have expired, we will proceed to eliminate them in a safe and environmentally friendly way. In the case of commercial communications, we will keep your address until you unsubscribe or object, and afterwards blocked solely so that we do not write to you again.
What are your data protection rights?
At any time you may exercise your rights of access, rectification, erasure, objection, restriction of processing and portability, and withdraw any consent you have given us, without affecting the lawfulness of previous processing. To exercise them, simply write to our postal address or to admin@muchocartucho.es stating which right you wish to exercise. We will only ask you to prove your identity if there is reasonable doubt about it. To find out more about your data protection rights, you can consult the website of the Spanish Data Protection Agency (www.aepd.es).
Can you withdraw your consent if you change your mind later?
You can withdraw your consent if you change your mind about "the use of your data" at any time. For example, if you once agreed to receive advertising about our products or services and no longer wish to receive it, you can unsubscribe from the link included in every email, from your customer area or by writing to admin@muchocartucho.es. You may also object at any time to receiving commercial communications even if you never consented to them, for example if you receive them because you are a customer.
In case you understand that your rights have been unattended, where can you make a claim?
In case you understand that your rights have been disregarded by our entity, you can file a claim with the Spanish Agency for Data Protection, through any of the following means:
- Electronic office:
sedeagpd.gob.es (www.aepd.es)
-
Postal address:
Agencia Española de Protección de Datos
C/ Jorge Juan, 6
28001-Madrid
Filing a claim with the Spanish Data Protection Agency does not entail any cost and the assistance of a lawyer or solicitor is not necessary.
Will we create profiles of you?
We do not profile your data beyond what is described below. For commercial communications we only use your price list or customer type and your country or province to decide which campaigns we send you. The content of each offer is defined by catalogue and is the same for all its recipients, except for products that are not available to you. We do not make automated decisions that produce legal effects concerning you or similarly significantly affect you. In this case, we will apply effective security measures that protect your information at all times from unauthorized persons who intend to use it for their benefit.
Will we use your data for other purposes?
Our policy is not to use your data for purposes other than those that we have explained to you. If, however, we need to use your data for different activities, we will always request your permission in advance through clear options that will allow you to decide in this regard.
